Welcome to GolfTreks.com.au (“GolfTreks”, “we”, “our”, or “us”). These Terms of Use (“Terms”) govern your access to and use of our website, services, listings, and marketplace platform (the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

1. Use of the Site

You represent that you are at least 18 years old. You agree to use the Site only for lawful purposes and in accordance with these Terms. We reserve the right to refuse service, suspend or terminate accounts at our discretion.

2. Marketplace Role

GolfTreks is an online marketplace platform that facilitates the display of golf travel packages and connects travellers (“Users” or “Travellers”) with independent travel operators (“Operators”). We do not operate, control, manage, or fulfil travel services offered by Operators nor act as an agent or principal for any booking or contract between a Traveller and an Operator. Your use of the Site means you understand and acknowledge our role as a facilitator only.

3. Accounts & Listings

Operators may create accounts and list travel packages on the Site. By creating an account or listing, you represent and warrant that you are authorised to act on behalf of the business you represent and that all information you provide is accurate, current, and complete.

Operators may add unlimited listings to the platform at no cost. GolfTreks does not charge listing fees or commissions for bookings made between Travellers and Operators at this time.

Operators are solely responsible for the content of their listings, including pricing, availability, itinerary details, imagery, descriptions, and Terms of Sale for their services. You agree not to post content that infringes on intellectual property or that is false, misleading, defamatory, obscene, unlawful or otherwise prohibited.

4. Booking & Payments

Travellers interested in a travel package may submit an enquiry or otherwise contact the Operator directly. All bookings, reservations, payments, deposits, and service agreements are made exclusively between the Traveller and the Operator. GolfTreks does not process payments on behalf of Operators nor manage booking fulfilment.

You understand that Operators may have their own booking terms, refund policies, and service guarantees. GolfTreks is not responsible for the performance, accuracy, completeness, legality, or any other aspect of any package offered by an Operator.

5. Traveller Responsibilities

Travellers are responsible for verifying travel requirements (such as visas, passports, health requirements, insurance, and eligibility), confirming booking terms with Operators, and ensuring satisfaction with services. All disputes relating to travel services, delivery, or Operator conduct must be addressed directly with the Operator.

GolfTreks expressly disclaims any liability for issues arising out of travel arrangements, cancellations, delays, or other acts or omissions of Operators or third parties.

6. Intellectual Property

All content on the Site, including text, graphics, logos, images and software, is owned by GolfTreks, its licensors, or associated content providers. You may not reproduce, modify, distribute, display, or use any content for commercial purposes without our prior written consent.

Operators retain rights to their own listing content but grant GolfTreks a non-exclusive licence to display and distribute that content on the Site and in association with the operation of the marketplace.

7. User Conduct

You agree not to misuse the Site, including but not limited to:

Posting unlawful, harmful, or offensive content

Violating intellectual property rights

Attempting to access restricted portions of the Site

Interfering with Site operations or other users’ access

GolfTreks may remove or edit content that violates these Terms or that we deem inappropriate, without notice.

8. Liability & Disclaimers

To the maximum extent permitted by law, GolfTreks provides the Site “as is” and disclaims all warranties, whether express or implied, including but not limited to accuracy, reliability, completeness, or suitability for a particular purpose.

GolfTreks is not liable for any loss, damage, injury, claim or expense (direct, indirect, incidental, punitive, or consequential) arising from your use of the Site, listings, bookings or travel services provided by Operators.

9. Indemnity

You agree to indemnify, defend and hold harmless GolfTreks and its officers, directors, employees and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your breach of these Terms, your misuse of the Site, or your interactions with other users.

10. Termination

We may suspend or terminate your access to the Site at any time, without notice, if you breach these Terms or for any other reason. Termination does not affect rights accrued prior to termination.

11. Changes to Terms

We may update these Terms at any time. The most recent version will always be available on this page. Continued use of the Site after updates constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Queensland.
